Advantages

Not suitable for short-term commercial rental to tourists (often limited by regulations). Higher purchase price than a comparably large family home. High annual management fees - can be tens of thousands of THB. After 10 years, there is a risk of obsolescence, a decrease in guests and increasing service costs. If the quality of management decreases, the services and attractiveness of the property may deteriorate.

Lower purchase price compared to an apartment of the same size by the sea. Own land – more privacy and the possibility of your own modification. Suitable for commercial rental (long and short term). Possibility of easy reconstruction, extensions or modernization.
Disadvantages
Usually the distance from the sea is 5 km or more. Requires regular maintenance of the house (although construction work and materials are cheaper in Thailand). The owner is responsible for the care of the pool and garden. Greater distance from the city center – usually 3 to 20 km.

Once you have chosen a property that suits your needs, it is time to make an offer. This stage is flexible and allows you to specify what you want to be included in the sale – for example, furniture, fixtures or other equipment – and to state any specific terms you have in mind. Honesty is key: tell us clearly what you want. We will represent your interests and present your offer to the seller to ensure that your terms are taken into account. This is also a good opportunity to discuss any requirements you as a buyer have for the seller, such as requests for repairs or alterations to the property. Keep in mind that realistic and reasonable requirements can make negotiations go more smoothly and make it easier to reach an agreement that is satisfactory to you.
We will make sure that every legal detail is carefully reviewed and made clear to you. We will verify that the property is free of any debts and that all necessary documents such as licenses and registrations are valid (this step takes place after signing the reservation agreement). Legal due diligence is especially important for foreign buyers, as the legal system in Thailand may be different from what you are used to. Once you have chosen your ideal property, we will recommend an experienced lawyer from a reputable law firm who will take care of all legal matters, while we will coordinate the process and provide support in Czech.
If you choose a property after viewings, we recommend granting a power of attorney to your legal representative. This step is often necessary in Thailand and is easier to arrange during your stay in the country. One of the first steps involves verifying your identity and the origin of your funds. A lawyer will also help you obtain a Thai tax identification number, which you will need for legal transactions in the country. He will then help you open a local bank account, which is necessary to manage payments associated with your new property in Thailand.
A reservation deposit of 5% of the property price is payable upon signing the reservation agreement. Please note that the deposit is not an additional fee; it is part of the purchase price and will be deducted from the total amount due upon closing. This deposit also triggers a thorough legal due diligence process where your lawyer verifies that the property is free of debt and that all necessary documentation, such as licenses and registrations, is current and valid. It is important to note that if you, as the buyer, decide not to proceed after this point, the deposit is non-refundable. If the seller does not want to proceed, they are required to compensate you with double the deposit.

A title search is a necessary step in the process of buying property in Thailand. Here are the reasons why a title search is a "must":
A title search is performed to determine whether the person selling you the property is the true owner of the property and can sell it to you.
It also determines whether there are any recorded encumbrances on the property, such as a loan, lien, or mortgage.
A title search traces the ownership of the land back to the original owner of the property. In Thailand, all land originally belonged to the king.
The signing of the title deed is the final step in the sales process, scheduled for a date agreed upon by both parties – the buyer and the seller.
Before the actual signing, a final inspection of the property is often carried out. This inspection is usually attended by agents, buyers and sometimes lawyers to ensure that the property is in the condition agreed upon and that no new problems have arisen. The actual signing of the title deed takes place in front of a Thai notary and is the official closing of the sale. The deed contains all the details of the property: its complete description, the agreed price, the method of payment, the date the property is handed over to the buyer, any maintenance issues, the current condition of the property and also situations where the seller may still be liable (e.g. hidden defects).
Once the deed is signed, you or your lawyer will hand over the keys to the buyer in exchange for payment of the remaining amount for the property. From the moment of signing, the property officially becomes the property of the new owner. This process may differ slightly from the procedure in your country, especially when it comes to legal and notarial formalities.

After purchasing your property in Thailand, there is a post-sale process. Most of this work will be done by a lawyer for you. He will rewrite your name on the water, electricity and other utility bills as the new owner of the property. He will also help with the taxes and fees associated with the transfer of the property. This includes property transfer tax and notary and land registry fees. These fees cover the legal services provided during the purchase. At this stage, the lawyer can also help you open a Thai bank account if this was not already done during the purchase process. Finally, you will pay your lawyer for his support and services throughout the process. This completes the purchase process and you can fully enjoy your new property.
